Mutual consent divorce is one of the easiest and relevant ways to dissolve the marriage.
As understands by the name mutual consent divorce basically means the divorce in which both husband and wife agree to be separated without any hassle or chaos.
Different religion, different acts, and different laws:
  • Hindu Marriage Law: For Hindu as well as also included Sikhs, Jains, and Buddhists, their marriages and all the divorce cases are taken under the Hindu marriage act 1956.
  • Muslim Marriage Law: For Muslims marriages are done under the shariyat and divorce are mainly governed by personal laws of divorce and dissolution of marriage 1939 whereas for women as for the protection of rights on divorce act 1986, that is also called as the Muslim women act 1986.
  • Christen Marriage Law: For christen marriages and divorce there is the Indian christen marriage act 1972 and for their divorce Indian divorce act, 1869. Same for the Parsis, their marriages and divorce are governed under the act called the Parsi marriage and divorce act 1936.
Once the application of the mutual consent divorce is filled then both the husband and the wife have to record their statement in the front of the court.
